GOVERNMENT TAKEN TO COURT OVER ICC
On Wednesday December 20th, two lawsuits were filed against
a number of federal agencies. These suits allege that the Federal Highway
Administration, the U.S. Department of Transportation, and the Army Corps of
Engineers violated several laws in their actions regarding the Intercounty
Connector (ICC).
One suit was filed by Environmental Defense and the Maryland Chapter of
Sierra club and addresses serious air quality issues.
The second lawsuit, filed in the U.S. District of Maryland by ANS, the MD
Native Plant Society and local Derwood residents Roger Metcalf and Eve Burton,
argues that the government violated the National Environmental Policy Act – as
well as the Department of Transportation Act, the Clean Water Act, and the
Administrative Procedure Act.
